Bayo Dayo appeals court judgement in Kashamu’s favour

Former chairman of the Peoples’ Democratic Party (PDP) in Ogun state, Engr Bayo Dayo has filed an appeal against the ruling of an Ogun state high court sitting in Ijebu-Ode, which was in favour of Senator Buruji Kashamu.

Dayo and his son Bola Dayo had filed a suit at the high court against the Police and Senator Kashamu, alleging that that fundamental rights to freedom of movement, association and ownership of property were about to be violated.

In the suits number HCJ/64/2020 and HCJ/65/2020, Dayo and his son, Bola, asked the court to restrain the Assistant Inspector-General of Police (AIG Zone 2), the Commissioner of Police, Ogun State and the Divisional Police Officer (DPO), Ijebu-Igbo, Ogun State, from arresting and detaining them over the complaints made against them by Senator Kashamu.

However, the judge, Honourable Justice O.S Olusanya ruled against the duo, and asserted that both suits from Dayo and his son were an abuse of court processes and dismissed them.

He thereafter awarded a cost of N150,000 against Dayo and N100,000 against Bola.

Meanwhile, Engineer Dayo, in a notice of appeal obtained by Salient Times, expressed dissatisfaction over the court judgement against him and asked the appeal court to quash the ruling.

Engr. Dayo argued that the trial court erred in law to have held that the first respondent (Police) has the right to investigate any allegation of crime

He also argued that there is no justifiable suspicion that he and his son committed any crime from the petition of the 2nd respondent (Kashamu) to the Police.
